Terms of service
Last updated: September 11, 2026
The short version. Buy a hat, we make it and ship it. Custom orders start at 5 hats, we send you a free mockup, and once you approve it we make exactly what you approved — so read it carefully. Send us artwork you actually have the right to use. Handmade means small variations; that's the product, not a defect. If something is genuinely wrong with a hat, tell us and we'll make it right. The rest is the careful version.
1. Agreeing to these terms
These Terms of Service govern your use of hatandpatch.com and everything you buy through it (the "Services"). They are an agreement between you and Hat & Patch Co. Using the Services or placing an order means you accept them. If you don't accept them, don't order.
If you're ordering on behalf of a company or organization, you're confirming that you're authorized to bind it to these terms.
These terms incorporate our Privacy Policy. Where the two conflict on anything concerning your personal information, the Privacy Policy controls.
2. Eligibility and accounts
You must be at least 18, or old enough to enter into a binding contract where you live, to place an order.
If you create an account, keep your password to yourself — you're responsible for everything that happens under it. Tell us promptly if you believe it's been compromised.
3. Orders and pricing
- All prices are in US dollars.
- Placing an order is an offer to buy. We accept it when we charge your payment method and send an order confirmation.
- Prices, products, and promotions may change without notice.
- Listings occasionally carry errors — a wrong price, description, or availability. Where something is clearly mispriced or misdescribed, we may cancel the order and refund you in full rather than honor it. We'll tell you if we do.
- We may refuse or cancel any order, or limit quantities, at our discretion.
- Promotions apply as stated, one per order unless we say otherwise, and can't be applied retroactively to a completed order.
- Applicable taxes and duties are calculated and shown at checkout where required.
4. Custom orders
Minimum order. 5 hats. Per-hat pricing drops at 5, 12, 24, 50, 100 and 200+ hats, based on the total number of hats in your order — mixing hat styles doesn't cost you the tier. There is no setup fee, ever.
Mockup and approval. Every custom order comes with a free digital mockup if you want one. Order through the customizer and you choose: ask for a mockup, and nothing goes into production until you approve it; or tell us to make it as designed, and we make exactly what you built. If you ask us to build your mockup on a placed order, approval has a deadline. If you order through the customizer and ask us to build your mockup, you have five business days from the day we send your proof to approve it or tell us what to change. If we haven't heard from you by then, we treat the mockup as approved and make the order as shown. We may send a reminder, but the deadline applies whether or not you receive one. Mockups you request before placing an order have no deadline — reply whenever you're ready. Once you approve a mockup, it is the specification — we make what's on it, including any typo, wrong area code, or misspelled name that made it through. The same goes for a design you submit as-is.
Changes after approval may not be possible. If production hasn't started, we'll do what we can. If it has, a change means a new order.
Turnaround is 2–3 weeks from approval to ship. Rush production is sometimes available — ask before you order, not after. Turnaround is an estimate, not a guarantee.
Handmade variation. Every hat is stamped by hand, one at a time, in full-grain leather. Leather is a natural material: color, grain, and finish vary between hides and between patches. Stamp depth and position vary slightly. Screens don't render leather color accurately. These variations are characteristic of the product, not defects, and are not grounds for a return.
Cancellation. You may cancel a custom order at any point before you approve the mockup — or, on an as-designed order, before production starts. After approval we've begun committing materials and production time, so cancellation may not be possible, or may be partial depending on where the order stands. Contact us as soon as possible and we'll tell you honestly what's still reversible.
5. Your artwork
When you send us a design, logo, text or file, or build one in our customizer, you're telling us three things:
- You own it, or you have permission to use it. For a business logo, that means you have the right to have it reproduced on merchandise.
- It doesn't infringe anyone's copyright, trademark or other rights, and doesn't break any law.
- You'll cover us if that turns out to be wrong. If someone brings a claim against us over artwork you supplied, you're responsible for the resulting claims, damages and reasonable legal costs.
The license you give us. You keep all rights in your artwork. You grant us a non-exclusive, worldwide, royalty-free license to reproduce it, adapt it as needed for production, and display it — for the purposes of making your order, keeping it on file for reorders, and showing finished work in our portfolio and marketing. You can withdraw the portfolio and marketing portion of that license at any time by emailing us; the production portion lasts as long as we're making your order.
What we won't print. We may decline any design, at any point, without giving a reason. Things we will decline: artwork we believe infringes someone else's rights; brands, logos or licensed properties you don't hold rights to; and content that is hateful, harassing, sexually explicit, or promotes violence or illegal activity. If we decline after you've paid, we refund you in full.
Reviewing your design for legal problems is not our job and we don't do it. Declining something is a business decision, not a legal clearance — and not declining something isn't legal clearance either.
6. Shipping
Our Shipping Policy forms part of these terms and governs delivery in full. Where it and this section differ, the Shipping Policy controls. In summary:
- We ship within the United States only. Rates are shown at checkout and no additional customs charges, duties, or brokerage fees are payable on delivery.
- Production and delivery times are estimates, not guarantees. Our designs are made in 3–5 business days; custom orders ship 2–3 weeks from your approval of the mockup. Once a package is with the carrier, timing is outside our control.
- Risk of loss passes to you when the carrier takes possession of your order. If a package goes missing in transit, contact us and we'll help you resolve it with the carrier.
- You're responsible for providing a correct and complete shipping address. Packages returned to us as undeliverable are refunded less original shipping, or reshipped once you cover shipping again.
7. Returns, exchanges and refunds
Our Return & Refund Policy forms part of these terms and governs returns, exchanges and refunds in full. Where it and this section differ, the Return & Refund Policy controls. In summary:
- Our designs may be returned or exchanged within 30 days of delivery, unworn, unwashed, and in original condition with tags and packaging, provided you request a return from us first. Refunds are issued to the original payment method within 10 business days of approval.
- Return shipping is your cost for change-of-mind returns and exchanges, and original shipping charges are not refunded. We cover shipping both ways where an item is defective, damaged in transit, or not what you ordered.
- Custom orders are final sale, because a hat stamped with your design can't be resold. That doesn't extend to our errors: if what arrives doesn't match the mockup you approved or the design you submitted, or is defective, we remake or refund it at our cost.
- Sale and clearance items are final sale, except where defective or misdescribed.
- The lifetime warranty in section 8 is separate from and unaffected by the 30-day return window.
8. Warranty
We stand behind the work. We warrant every hat we make — the leather patch, the heat-stamped impression, and the hat itself — against defects in materials and workmanship, for the life of the hat. If the patch separates, the stamped impression fails, a seam gives out, or the closure breaks under normal wear, tell us and we'll repair or replace it.
What that doesn't cover: normal wear and tear — sun fading, sweat marks, and the patina leather develops over time; damage from accident, misuse, improper cleaning, or alteration by anyone else; the natural material variation described in section 4; fit or sizing preference; and anything caused by an error on a mockup you approved or a design you submitted as-is.
This warranty is offered by us directly, applies to the original purchaser, and is in addition to any rights you have under applicable consumer law.
9. Our intellectual property
The Services — including our name, logo, product photography, copy, patch designs, and the arrangement of the site — belong to us or our licensors and are protected by intellectual property law. You may not copy, reproduce, distribute, or use them commercially without our written permission. Buying a hat doesn't license any of it.
10. Things you can't do
Don't use the Services to break the law, harass anyone, scrape or bulk-download our content, introduce malicious code, probe or test our security, impersonate anyone, misrepresent your affiliation, or interfere with anyone else's use of the Services.
11. Reviews and submissions
If you post a review, comment, or other content through the Services, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce and adapt it, with attribution to the name you posted under.
Don't post anything false, defamatory, infringing, or unlawful. We may remove any submission, for any reason, without notice.
12. Third-party tools and links
Parts of the Services run on third-party services — our ecommerce platform, the design customizer, forms, scheduling, payments and analytics. They're provided on an "as is" basis. We don't control them and we're not responsible for them. Where they have their own terms, those govern your use of them.
Links to third-party sites are provided for convenience and don't imply endorsement.
13. Disclaimers
The Services and everything on them are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We don't warrant that the Services will be uninterrupted, timely, error-free, or secure, or that any content on them is accurate, complete, or current.
Nothing in this section excludes any warranty or right that cannot lawfully be excluded, including the express warranty in section 8 and any non-waivable rights you have under consumer protection law.
14. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising out of or relating to your use of the Services or any order, regardless of the legal theory and even if we've been advised such damages are possible.
To the fullest extent permitted by law, our total aggregate liability for any claim relating to an order is limited to the amount you paid for that order.
Some jurisdictions do not allow the exclusion or limitation of certain damages. Where that's the case, these limitations apply only to the extent the law permits, and nothing here limits liability for fraud, fraudulent misrepresentation, or anything else that cannot lawfully be limited.
15. Indemnification
You agree to indemnify and hold harmless Hat & Patch Co. and the people who work with us from any claims, damages, losses, liabilities and reasonable legal costs arising out of your breach of these terms, your misuse of the Services, or — as set out in section 5 — artwork you supplied to us.
16. Governing law and disputes
These terms and any dispute arising out of them or your use of the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-laws principles. You and we agree to the exclusive jurisdiction of the courts located in Ontario, Canada.
If you're a consumer, this doesn't take away your rights. Nothing in this section deprives you of the protection of any mandatory consumer-protection law of the state or country where you live, or of your right to bring a claim in a small claims court in your own jurisdiction where that court would otherwise have jurisdiction. Where the law of your home jurisdiction gives you a right that this section would otherwise remove, that law prevails.
Before starting any formal proceeding, please contact us at hello@hatandpatch.com. Most problems can be resolved a great deal faster that way, and we'd rather fix the hat.
17. General
Severability. If any provision of these terms is found unenforceable, it will be limited or severed to the minimum extent necessary and the rest remains in full effect.
No waiver. Our failure to enforce any provision isn't a waiver of our right to enforce it later.
Assignment. You may not assign or transfer your rights under these terms. We may assign ours in connection with a merger, acquisition, or sale of the business.
Force majeure. We're not liable for delay or failure to perform caused by events beyond our reasonable control, including supply interruptions, carrier failures, and natural events.
Entire agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services and supersede any prior understanding.
18. Changes to these terms
We may update these terms from time to time. We'll post the revised version and update the "Last updated" date. Orders are governed by the terms in effect at the time you placed them. Continuing to use the Services after a change means you accept the revised terms.
